On September 28, 2026, Frank A. Vasconcelos II, Junior Partner, obtained an early dismissal with prejudice for our client, a commercial property owner, in a trip and fall matter. A focused review of property records, aerial imagery, and the Plaintiff's own disclosures showed the incident location was owned and controlled by a separate, non-party entity, and under Florida law, no ownership, possession, or control means no duty. After we served a demand for dismissal and signaled our readiness to seek summary judgment under section 57.105, Florida Statutes, the Plaintiff voluntarily dismissed all claims against our client with prejudice.
