Miami Junior Partner Anthony Perez, Esq., obtained summary judgment in the matter styled John and Suzanne Akucewicz v. Citizens Property Insurance Corporation. The Plaintiff filed suit claiming damage to their property from a sudden and accidental discharge of water from within a plumbing system. Mr. Perez argued that there was no evidence of any damage to the property resulting from the reported plumbing discharge, and to the extent there could have been any damage, our client was entitled to a presumption of prejudice which the Plaintiff failed to rebut.
